Royal Mail Group Ltd has been guilty of violating Section 2 of Health and Safety Act after the death of the employee at the workplace four years ago.

The accident leading to the prosecution happened in September, 2006, when Colin Smith, a yard shunter, got trapped between a trailer and tractor while working at the Heathrow Worldwide Distribution Centre (HWDC) of Royal Mail causing death of the shunter.

The company was fined £90,000 along with costs of £42,549.56 for the violation of safety regulations by the Reading Crown Court.

The incident took place when a Royal Mail HGV driver was trying to line his tractor with the trailer unit that was already parked in HWDC loading space. However, while reversing his trailer, he did not notice that Mr. Smith was working in the trailer and later found that Mr. Smith was trapped between the two wagons and severely injured, and the injuries eventually proved to be fatal.

The HGV driver was also charged under Section 7 of the Health and Safety at Work etc Act 1974, however, in the judgment delivered on 1 March 2010, he was exonerated. The judge fined Royal Mail Group Ltd but said he would have been inclined to increase the fine by £30,000 had Royal Mail not pleaded financial difficulties. He said that although he did not believe that the company was directly responsible for Mr. Smith’s death, if a few safety measures were taken the accident could have been avoided, though it was hard to be certain that it would have been. Therefore, in wake of the pleas made by the company, the fine was reduced.
